What is insurance bad faith?
Insurance bad faith occurs when an insurance company unreasonably denies, delays, or underpays a valid claim. This can include failing to properly investigate claims, misrepresenting policy provisions, or making unreasonably low settlement offers. If proven, bad faith claims can result in additional damages beyond the policy limits.
How long does an insurance company have to settle a claim in Texas?
Under Texas law, an insurer must acknowledge receipt of a claim within 15 business days, commence its investigation within that same 15-business-day period, and accept or reject the claim within 45 business days, unless a statutory extension applies. These deadlines are measured in business days as defined by the Texas Department of Insurance, not calendar days. An insurer’s failure to comply with these statutory timeframes may constitute a violation of the Texas Insurance Code.
